Terms of Service

Welcome to Peek The Look, a fashion try-on mobile application operated by the development team ("we", "our", or "us").

These Terms of Service ("Terms") govern your access to and use of our mobile app and website (collectively, the "Services").

By using our Services, you agree to these Terms and our Privacy Policy. These Terms include a mandatory binding arbitration clause in Section 16 and a class action waiver, which requires that all claims be resolved in individual arbitration.

If you do not agree, do not use our Services.

1. Overview and Acceptance

Peek The Look allows users to upload model photos (which may be of themselves or others) and garment images (clothes, dresses, etc.) to generate fashion try-on visuals using AI technology. You accept and agree to be bound by these Terms by using the Service.

2. Eligibility and Age Restriction

You must be at least 16 years old to use our Services. By using our Services, you represent that you meet this requirement and that all information you provide is accurate.

3. Accounts

To access most features, you must create an account. You are responsible for:

• Maintaining the confidentiality of your credentials.
• All activities under your account.
• Ensuring the accuracy of your information.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content and Intellectual Property

4.1 Ownership and License to Us

• Ownership: You retain ownership of any photos, garments, or other content you upload ("User Content").
• License: By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to:
  • Process and modify your content for the sole purpose of providing the Services.
  • Display and store generated results for you.
  • Use anonymized and aggregated data for research, analytics, and improvement of our AI systems.

4.2 Responsibility

You represent and warrant that:

• You own or have permission to use the User Content, including the right to upload images of any persons contained therein.
• The content does not infringe third-party rights.
• The content does not include unlawful, explicit, or offensive material.

We may remove any User Content that violates these Terms.

5. Subscriptions, Credits, and Payments

5.1 Plans and Billing

Our Services may be accessed through Subscription Plans (recurring), One-Time Purchases (fixed), and Credits (virtual units consumed per generation). Subscriptions are billed through Apple's App Store and automatically renew unless canceled.

5.2 Refunds

All payments are non-refundable, except where explicitly required by law or Apple's refund policy.

5.3 Fee Changes

We may change plan prices or credit costs with prior notice. Continued use after changes constitutes acceptance.

6. Credits and Usage

Each try-on or AI generation consumes credits. Unused credits may expire based on your plan terms. Credits have no monetary value and cannot be transferred or exchanged.

7. AI Service and Prohibited Conduct

Our Service relies on third-party AI technology. Your use of the Service is governed by the following restrictions:

7.1 AI Partner and Compliance

We use Google Gemini AI and other third-party services. By using our Service, you agree to comply with all applicable policies, including the Google Generative AI Prohibited Use Policy and its equivalents for any future provider.

7.2 Prohibited Uses and Content Restrictions

You agree not to use the Service to upload, generate, or facilitate any content related to:

• Any unlawful purpose or activity.
• Violating any intellectual property or privacy rights.
• Child sexual abuse or exploitation.
• Non-consensual intimate imagery.
• Promoting, facilitating, or depicting violence, self-harm, hate speech, or harassment.
• Sexually explicit content or content created for pornography or sexual gratification.
• Content intended for fraud, scams, or deceptive practices.
• Transmitting viruses or malicious code.
• Commercial use without authorization.
• Reverse-engineering or hacking the service.

7.3 Content Monitoring and Enforcement

We may use automated systems and human review to monitor content for compliance. Prohibited content will be automatically rejected or removed. Repeated violations, or uploading content that violates our AI provider's policies, may result in immediate account suspension or termination.

8. AI Outputs and Disclaimers

8.1 Simulation Only

The AI-generated try-on images are based on your input and are simulations only. They are not guaranteed to be accurate, realistic, or fit any specific purpose (e.g., professional modeling, fashion design specifications).

8.2 No Guarantee

Generated results may differ significantly due to model limitations, lighting, photo quality, and AI processing limitations. We are not responsible for any outcomes or decisions made based on these simulated results.

9. Intellectual Property

The App, software, logos, trademarks, and AI technology are owned by Peek The Look or our licensors. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial use only. Any feedback or suggestions you provide may be used by us freely and without obligation.

10. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our separate Privacy Policy. By using the service, you consent to the data practices outlined therein.

11. Termination

• By You: You may cancel your subscription or delete your account at any time.
• By Us: We may suspend or terminate access to the Services immediately if you violate these Terms, we detect misuse, or if required by law or platform regulations.

After termination, your license to use the Services ends immediately, and remaining credits may be forfeited.

12. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind. We make no warranties regarding availability, accuracy, or fitness for a particular purpose. We do not guarantee that the App will be error-free or uninterrupted.

13. Limitation of Liability

To the fullest extent permitted by law:

• We shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or goodwill.
• Our total liability for any claim arising out of these Terms shall not exceed the amount you paid to us in the last six (6) months.

14. Indemnification

You agree to indemnify and hold harmless us (the developers of Peek The Look) and our affiliates from any claims, damages, liabilities, and expenses arising out of your:

• Use of the Services.
• Uploaded content (User Content).
• Violation of these Terms or applicable laws.

15. Modifications

We may modify these Terms at any time. We will notify you through the App or email. Your continued use after such modifications constitutes acceptance.

16. Dispute Resolution, Binding Arbitration, and Class Action Waiver (MANDATORY)

Please read this section carefully as it requires you and Peek The Look to resolve disputes through binding, individual arbitration and limits the ways you can seek relief from us.

16.1 Agreement to Arbitrate

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration.

16.2 Waiver of Class and Representative Actions

You and Peek The Look agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a class or representative proceeding.

16.3 Arbitration Rules and Location

The arbitration shall be administered by a mutually agreed-upon international arbitration organization (such as the International Chamber of Commerce - ICC), or if no agreement is reached, by the Turkish Union of Chambers and Commodity Exchanges (TOBB) Arbitration rules.

• The arbitration shall be conducted by a single arbitrator.
• The arbitration will be held remotely via video or telephone conference unless the parties mutually agree to an in-person hearing in İzmir, Türkiye.
• The language of the arbitration shall be English.

16.4 Exceptions to Arbitration

Notwithstanding the above, either party retains the right to bring an individual action in a small claims court located in İzmir, Türkiye or to seek injunctive relief in a court of law to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

16.5 Governing Law

These Terms and the use of the Services shall be governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to its conflict of law provisions.
